By submitting this application, the Operator declares and agrees to each of the following:


Accuracy of information: All information provided in this application is true, accurate, and complete to the best of the Operator's knowledge. The Operator acknowledges that any false or misleading information may result in refusal of services or termination of any agreement entered into.


Cooperation and access: The Operator agrees to provide all reasonable access, assistance, and cooperation required by ComplyAssist Australia Pty Ltd in the course of delivering services under the ComplyAssist System, including timely responses to requests for information and documentation.


Notification of changes: The Operator agrees to notify ComplyAssist Australia Pty Ltd promptly of any material changes to the business — including changes to accreditation status, fleet size, key personnel, operating conditions, or regulatory circumstances — that may affect the delivery of services.


Legislative monitoring: The Operator understands that relevant Acts, Regulations, and Standards are subject to amendment and that it remains the Operator's responsibility to monitor and respond to regulatory changes in accordance with their obligations as a PCBU and duty holder under applicable legislation.


Payment: The Operator agrees to pay all fees and charges for services in accordance with the terms set out in the relevant service agreement or proposal. For audit services, payment is due in full upon completion of the onsite component and prior to release of the Audit Summary Report.


Indemnity: The Operator shall indemnify, hold harmless, and guarantee ComplyAssist Australia Pty Ltd and its officers, employees, agents, and subcontractors against any and all claims, losses, damages, or expenses (including legal costs) arising from the performance, purported performance, or non-performance of contracted services, howsoever arising.


Confidentiality: ComplyAssist Australia Pty Ltd agrees to treat all information provided by the Operator as confidential and will not disclose such information to any third party without the written consent of the Operator, except where required or authorised by law.


Privacy: Personal information collected in this application will be used solely for the purpose of providing ComplyAssist services and directly related purposes, in accordance with applicable Australian privacy legislation.
